These Terms of Use ("Terms") govern your use of pricetickers.com (the "Site"), operated by Peter Holzhauser, Dinkelsbühlerstr. 38, 70374 Stuttgart, Germany ("we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site is
PriceTickers is a free information service. It collects publicly available prices of new products offered on Amazon.com and eBay, and publishes price histories, price charts and price indices for markets and sectors. Amazon.com prices are shown only as current prices (no more than 24 hours old, with a timestamp) and are not included in price histories, charts, indices or price movements. We do not sell any products, we are not a party to any purchase, and we do not process payments. Any purchase is made directly with the respective retailer or seller under their terms.
2. No guarantee of prices or availability
Prices and availability shown on the Site are accurate as of the date and time indicated and are subject to change. Any price and availability information displayed on Amazon or eBay at the time of purchase will apply to the purchase of the product. Prices are shown in U.S. dollars and generally exclude sales tax and shipping, which are added by the retailer where applicable. Data is collected automatically and may be incomplete, delayed or incorrect; products may be matched to the wrong listing. We make no guarantee that the information is accurate, complete or current.
3. No purchasing, financial or investment advice
Price indices, "tickers", charts, rankings and "movers" on the Site describe historical retail prices of consumer products. They are provided for general information only. They are not securities, financial instruments or investment products, and nothing on the Site is purchasing, financial, investment, tax or legal advice. You are solely responsible for your decisions.

5. Acceptable use
You agree not to misuse the Site, including by: interfering with its operation or security; accessing it with automated means at a volume that places an unreasonable load on our systems; circumventing rate limits or access restrictions; or using the Site for any unlawful purpose. We offer a documented JSON API for reasonable, non-abusive use; we may limit or block access that exceeds reasonable use.
6. Intellectual property
The Site, including its design, text, software, price indices, charts and compilations of data, is protected by copyright and other laws. You may view and share pages for personal, non-commercial purposes and may quote individual figures with attribution to PriceTickers and a link to the Site. Any other reproduction, systematic extraction or commercial use requires our prior written permission.
7. Third-party trademarks and content
Amazon, Amazon.com and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates. eBay and the eBay logo are trademarks of eBay Inc. All other product names, brands and logos are the property of their respective owners. Their use on the Site is for identification only and does not imply endorsement by or affiliation with us. Product titles and images are provided by the respective retailers. Links to third-party websites are provided for convenience; we are not responsible for their content, products or practices.
8. Disclaimer of warranties
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ANY INFORMATION ON IT, INCLUDING PRICES, AVAILABILITY OR INDEX VALUES. BECAUSE THE SITE IS FREE, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in that case, these limitations apply only to the extent permitted. Nothing in these Terms limits liability for intent, gross negligence, or injury to life, body or health where such limitation is not permitted by applicable law.
10. Changes to the Site and to these Terms
We may change, suspend or discontinue the Site or any part of it at any time. We may update these Terms; the "Last updated" date shows the current version. Continued use of the Site after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer protection laws of the state or country where you live. Courts in Stuttgart, Germany, have jurisdiction, unless mandatory law allows you to bring a claim in the courts where you live.
12. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
